These Terms and Conditions (“Terms”) govern the legal relationship between The Niche Foundry Asia Positive Media LLP (operating as The Niche Foundry India / TNF India) and any person accessing, browsing, registering on, or engaging with india.datastack-global.com and its associated digital event platforms (“Event Platform”). The terms “Client”, “Delegate”, “Sponsor”, “Partner”, “Speaker”, or “You” refer to any individual or legal entity engaging with the Event Platform or attending the Data Stack Global India event (the “Event”). These Terms constitute an electronic record within the meaning of applicable law and do not require physical or digital signatures. By accessing the Event Platform, completing an event registration, purchasing a delegate pass, or confirming sponsorship, exhibition, or partnership participation, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

These Terms are the governing framework for all participants. Where a participant has executed a separate agreement with TNF India — including a Sponsorship Agreement, Speaker Agreement, or Delegate Agreement — that agreement supplements these Terms and prevails over them in the event of any conflict on its specific subject matter. In all other respects, these Terms apply in full.

Registration for Data Stack Global India is subject to availability and acceptance by TNF India at its sole discretion. The following applies to all registered participants: Ecosystem Integration: By registering for Data Stack Global India, you acknowledge that your professional profile becomes part of The Niche Foundry’s B2B ecosystem. This facilitates seamless access to our intelligence platforms, media, and future events, subject to our Privacy Policy. Participation in the Event does not guarantee any specific business outcome. Account Security: You must maintain the confidentiality of your registration credentials and restrict access to your devices. TNF India reserves the right to cancel registrations where duplicate, shared, or fraudulent accounts are detected. Eligibility: Registration is open to professionals who have attained the age of majority under applicable Indian law. By registering, you confirm that the information you have provided is true, accurate, and complete.

TNF India shall use reasonable efforts to adhere to the advertised agenda, speakers, venue, dates, and format of the Event as disclosed prior to the booking date. Notwithstanding this, TNF India reserves the right, without penalty, to: Modify the agenda, speakers, content, programme, or schedule at any time; or Change the venue, digital platform, or Event dates. Any material change will be communicated to registered participants via official email communication only or updated on the official event platform.

All prices are exclusive of applicable taxes, including Goods and Services Tax (GST), unless stated otherwise. Invoices must be paid within thirty (30) days of issuance or at least two (2) weeks before the Event, whichever is earlier, unless otherwise agreed in writing. Failure to pay within the stipulated timeframe may result in the cancellation of the booking without liability to TNF India. Non-payment of an invoice does not void your contractual obligations under these Terms or exempt you from applicable cancellation fees. We utilise secure third-party payment gateways; your use of such services is subject to their independent terms and conditions.

6.1 Cancellation by Delegates / Attendees

Given the operational and planning commitments required to deliver a premier event experience, the following cancellation structure applies: Cancellation within forty-eight (48) hours of booking confirmation is eligible for a 100% credit note, provided the booking date is at least thirty (30) days prior to the Event. Cancellation after forty-eight (48) hours but more than thirty (30) days prior to the Event is eligible for a 50% credit note of the amount paid. Cancellations made within thirty (30) days of the Event commencement date are not eligible for any credit note or refund. Failure to attend without prior written cancellation shall result in no credit note or refund being issued. Where payment has not been completed, 100% of the invoiced amount shall remain payable irrespective of cancellation. All credit notes are valid for twelve (12) months from the date of issue and may be applied towards registration fees for any future TNF India or Data Stack Global India event. Credit notes are non-transferable and carry no cash value.

6.2 Cancellation by Sponsors / Partners / Exhibitors

Sponsor, partner, and exhibitor cancellations are governed exclusively by the Sponsorship Agreement. Please refer to that document for the applicable cancellation and credit note structure.

6.3 Cancellation of Event by Organiser

If the Event is cancelled entirely by TNF India for reasons other than Force Majeure, a 100% credit note valid for two (2) years from the date of cancellation will be issued to all registered participants. No additional monetary compensation shall be payable by TNF India.

TNF India shall not be liable for any delay, postponement, or cancellation of the Event due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government restrictions, epidemics, pandemics, natural disasters, or technical or power failures (“Force Majeure Events”). In such circumstances, registered participation shall be transferred to a rescheduled Event, or a 100% credit note valid for two (2) years shall be issued. No additional compensation shall be payable in a Force Majeure scenario.

The branding, event identity, trade names, logo, layout, and intellectual framework associated with Data Stack Global are the exclusive property of The Niche Foundry Global L.L.C-FZ (UAE) (the “Licensor”). The Niche Foundry Asia Positive Media LLP organises and manages this Event under a legally binding, perpetual, and Intellectual Property License Agreement with the Licensor. All event materials, presentations, reports, digital content, and associated branding are protected under applicable intellectual property laws. Attendees, delegates, sponsors, partners, and exhibitors may not: Republish, redistribute, sell, rent, sublicense, or commercially exploit any event materials, presentations, or branding; Reproduce or copy event content without explicit prior written consent from TNF India; or Use the Data Stack Global or TNF India brand in any manner that is defamatory, misleading, or detrimental to the reputation of the Licensor or TNF India. Unauthorised use of intellectual property shall require immediate takedown upon notice from TNF India and may result in legal action.

9.1 Grant of Consent

By registering for and attending Data Stack Global India, you consent to being photographed, filmed, and/or audio-recorded. You grant TNF India a perpetual, global, royalty-free right to use such media for marketing, promotional, archival, and educational purposes across our digital platforms, B2B media assets, and partner ecosystems.

9.2 Opt-Out Mechanism

We respect your privacy. If you do not wish to be the subject of targeted photography or videography, you must notify the event organisers at the on-site registration desk. You will be provided with a specific visual identifier (e.g., a designated lanyard), and our media teams will make all reasonable efforts to avoid taking direct, identifiable images of you.

9.3 Incidental Capture

You acknowledge that live events involve dynamic crowd environments. The incidental inclusion of any attendee in wide-angle, panoramic, or general crowd shots does not constitute a breach of privacy, and such media may be used without restriction.

9.4 Post-Event Withdrawal

You may withdraw your media consent post-event by contacting our Grievance Redressal Officer at grievance@tnf-india.com. We will make commercially reasonable efforts to remove your identifiable image from future digital publications. However, we are not obligated to recall or alter previously printed materials, distributed partner assets, or live-streamed broadcasts.

By registering for or attending Data Stack Global India, you acknowledge that your personal data will be processed in accordance with our Privacy Policy published on india.datastack-global.com. This may include sharing your professional contact details with event sponsors, exhibitors, partners, or other registered attendees for event-related purposes. We encourage you to review the Privacy Policy prior to registration.

To the maximum extent permitted by applicable law, TNF India shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, business, goodwill, or third-party payments, arising out of or in connection with the Event or these Terms. Our total aggregate liability shall not exceed 100% of the amount actually paid by the Client for the specific Event registration, sponsorship, or services giving rise to the claim. Nothing in these Terms shall limit liability for fraud, wilful misconduct, or death or personal injury caused by negligence, where such limitation is prohibited by law.

You agree to indemnify and hold harmless The Niche Foundry Asia Positive Media LLP, its affiliates, officers, employees, directors, and agents from any claims, damages, liabilities, penalties, or expenses (including reasonable legal fees) arising from: (a) a breach of these Terms; (b) violation of any applicable law or regulation; (c) infringement of any third-party intellectual property or other rights; or (d) misuse of the Event Platform or Event services.

TNF India maintains a zero-tolerance policy towards harassment, discrimination, or offensive conduct based on gender, race, religion, age, disability, sexual orientation, or any other characteristic. Any participant found to be in violation of this policy may be immediately removed from the Event without refund, credit, or further recourse.

These Terms shall be governed by and construed in accordance with the laws of India. The courts of Mumbai, Maharashtra, India shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms or the Event.
